Has anyone read a good piece explaining what’s likely to happen when some officials in 2022/2024 try to overturn fair elections? What are the legal constraints or possible consequences? Where are the likely points of failure? How much will depend on idiosyncrasies of state law?
.@AthenianWalls highlights this piece by @marceelias which outlines a range of troubling scenarios and details how “the single point of greatest vulnerability for election subversion is the state certification of election results.”
“The strategic objective of nearly every move by the Trump team after the election was called for Joe Biden was to induce Republican legislatures in states that Biden won to seize control of the results and appoint Trump electors instead.”www.theatlantic.com/magazine/archive/2022/01/january-6-insurrection-trump-coup-2024-election/620843/ HT @AthenianWalls
On consequences: “There have been no criminal charges filed against any member of the seven slates of fake Republican electors who sought to overturn the 2020 presidential election results.” www.nytimes.com/2022/05/17/us/politics/wisconsin-fake-electors.html?unlocked_article_code=AAAAAAAAAAA...
On risks and remedies, @BrendanNyhan points to @rickhasen who writes “Of greatest concern,” the actions between the “Nov 2020 election through Jan 7, 2021, served as dress rehearsal for how to subvert election results in 2024 or in other future elections.”
How much of averting attempted coup in 2020 and 2021 depended on luck of who held office? “I think you replace those officials, those judges, with ones who are more willing to follow the party line, and you get a different set of outcomes.” — @KevinMKruse www.theatlantic.com/magazine/archive/2022/01/january-6-insurrection-trump-coup-2024-election/620843/
“Let’s state this plainly: Pennsylvania Republicans just nominated a full-blown insurrectionist who intends to use the power of the office to ensure that, as long as he is governor, no Democratic presidential candidate wins his state again.” wapo.st/38CqFQH
